These terms govern your use of Roaming Kiwi's eSIM products and services. Please read them carefully before purchasing.

These Terms of Service ("Terms") govern your use of the services provided by Roaming Kiwi ("we", "us", "our"), including the purchase and use of our eSIM products and related services. By purchasing or using our services, you agree to these Terms.

1. Our Services

We provide digital eSIM data plans that allow compatible devices to access mobile data networks in supported countries and regions. All eSIMs are delivered electronically and require a compatible, unlocked device.

2. Eligibility and Device Compatibility

You are responsible for ensuring that your device:

  • Supports eSIM technology
  • Is unlocked and compatible with the selected plan
  • Is correctly configured, including enabling data roaming

We are not responsible for issues caused by incompatible or unsupported devices.

3. Delivery and Activation

  • eSIMs are delivered digitally via email or download link
  • Delivery usually occurs within minutes of successful payment
  • Plan validity begins after activation unless otherwise stated
  • Unactivated eSIMs may expire after a stated pre-activation period

Once an eSIM is installed or activated, the service is considered used.

4. Usage and Fair Use

  • Data allowances, speeds, and coverage depend on the local network operator
  • Speeds may be reduced due to network congestion or after a data cap is reached
  • Use of the service for unlawful activity or abuse is prohibited

We reserve the right to suspend or terminate service if misuse is detected.

5. Pricing and Payments

  • All prices are shown in localised currencies where possible — you can select from the available options on our website
  • Payment must be completed before delivery
  • Prices and plan details may change at any time, without affecting existing orders

Payments are processed securely by Stripe. Roaming Kiwi does not store your card details.

6. Refunds and Cancellations

Refund eligibility is outlined in our Refund Policy, which forms part of these Terms.

In general:

  • Refunds are not available once an eSIM has been installed, activated, expired, or used
  • Refunds may be considered for unused eSIMs or verified technical issues

7. Service Availability

We do not guarantee uninterrupted or error-free service. Coverage and performance depend on third-party mobile networks and may vary by location.

We are not responsible for service interruptions caused by network providers, regulatory changes, or events beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential losses
  • Our total liability is limited to the amount paid for the affected eSIM

Nothing in these Terms limits your rights under applicable consumer protection laws.

9. Intellectual Property

All content, branding, and materials on our website are owned by Roaming Kiwi and may not be used without permission.

10. Privacy

Our handling of personal information is governed by our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website. Continued use of our services means you accept the updated Terms.

12. Governing Law

These Terms and any disputes are governed by the laws of New Zealand. You agree to the exclusive jurisdiction of the courts of New Zealand.
